Southdale, Armadale – Section 75A

Geddes provided planning advice and support for a Section 75A for EWP Investments Ltd to delete financial contributions towards the dualling of the A801 near Armadale. The total contributions required under the original Section 75 Agreement totalled around £3.3M at today’s date. Geddes worked collaboratively with Burges Salmon LLP and WSP, providing planning input and guidance to build a robust case for the deletion of the planning obligation. The DPEA Reporter agreed with the Appellant’s evidence on all points, concluding that the obligation failed to meet 4 of the 5 tests of Circular 3/2012 and should be deleted.
